Ah okay, you're right (and Rebecca too). I skimmed WoW's ToU and it does state in para. 8 that accounts are not to be sold. Seeing how many accounts are for sale I thought selling was allowed. I guess Blizzard doesn't enforce their own policies?



you should also take a look at how many accounts are being banned for being sold or even just being offered for sale when the seller is stupid enough to give the slightest hint on which account it is.
if the staff finds out which accounts are for sale, they will ban them without any way to unban it.

They definitely enforce it, just not publicly. Also, they can't completely enforce it, since they're working with a gigantic userbase and plenty of non-US players who have different laws applying to them.

I don't believe any country have law that over-rules the TOS, aka the contract between user and the company, in a civil lawsuit.

It's a matter of enforcement and cost to sue. Sometimes you just don't have a legal team posted in every country in the world.

Why would you, as a company, be suing them players, when all you need to do is ban their account.
The suing only comes from the players, when they feel that they are being treated unfairly by the company. But in this case, they have to prove that their selling of account does not violate the ToS, which is almost, if not, impossible.

It becomes an issue when the operation is from a 100-man office in China that hires out hackers to steal long-forgotten accounts and sell them off. In small cases, they just ban the account, but that's just a bandaid if there's a real-world industry built around it.
